
“Standing” in Court – Perhaps the most frequently cited rationale derives from the Constitution’s separation of powers among the branches of government.Issues of standing often arise when a private plaintiff sues the government, seeking to have it act in accordance with the Constitution or other law. But, as the Court has frequently noted, the Constitution makes the political branches—and not the courts—responsible for “vindicating the public interest.” As a result, unelected judges lack the authority to render advisory opinions as to whether Congress or the Executive has followed the law; they may only decide a specific case brought before the court by a party that has suffered a particularized injury as a result of the government’s actions. Such deference to the political branches, particularly in cases raising questions about the separation of powers,reflects the Court’s understanding of the “limited . . . role of the courts in a democratic society,”
The Supreme Court famously ruled in spite of overwhelming evidence that there was no standing to convict Joe Biden’s FBI for censuring millions of American’s free speech for years. Where is the standing of illegal foreign criminals to sue the President in District Court over their deportation? Particularly considering the presidential Alien removal act. Must the President suffer his every decision to all 94 district Court judges or wait months to allow appeals to work through to the Supreme Court? Is this the Constitutional process? Typically a District Court decision applies in that District only; how can it apply to the entire nation, without evidence it has happened in every District?
The Courts have become politically weaponized and are being manipulated by political activists. This can clearly be seen in the cases against Trump in recent years and now against his Presidency. Now that Congress is controlled by Republicans, the Judiciary is the last weapon the anti-American opposition can organize, besides funded protests in the streets and media propaganda. It should not be surprising the Courts are seeking to overrule Congress and the President. America had one foot in the grave as a result of the Biden Administration and whoever was directing it, but Trump is bringing life back with common sense, transparency, and Constitutional limitations on Government overreach, waste, fraud and abuse.
With no message or leader the Democrats have resorted to irrational shouting and arbitrary destructive violence. Will the Courts prosecute this violent criminal behavior? Does the rule of law remain in force for the prosecution of criminals, foreign and domestic? Are the Courts willing to set aside political agendas and focus on application of existing law, rather than seeking to forming it themselves? This is the eminent conflict, will truth or the lie prevail?
