Unconstitutional

The US Constitution includes the bill of rights, it guarantees our right to express our religious beliefs and free speech. There is a right to a speedy trial before a jury of our peers. It provides that due process must transpire before one is jailed or convicted. It provides that law is to apply to all equally. It prohibits Congress from passing laws that apply only to some or one person. There are many more specific freedoms which are extremely important and applicable to every citizen of the US. The 2nd amendment is short and clear – “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”

The context of many or most of these liberties are protections against Government denial or encroachment. For example, the right to bears arms shall not be infringed (by Government or anyone).  Similarly, the First Amendment restricts Congress, who makes laws, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” It has been determined these rights are protected from state and local governments also. 

In recent years, there have been an unprecedented numbers of violations by government against the Bill of Rights and Constitution collectively. Just this week, California passed a law that fast-food workers must be paid $20 per hour. This is unconstitutional in that it does not apply to all equally. The Constitution limits government intervention into our private lives. The Supreme Court ruled that Biden’s covid mandates were unconstitutional and that he could not fire people from their jobs for refusing a covid shot. Currently, the SCOTUS is hearing whether Biden’s censuring of speech by FBI agents imbedded into social media firms, was unconstitutional as determined  by District and Circuit Appeals Courts. Is this is the “Deep State” in action against the “People”? 

What may be effective against the Deep State is to have the Bill of Rights applied at the  individual government agent level. If FBI or other agents violate the rights of Citizen’s they should be held culpable along with their supervisor and executives who were also involved. This prevents government from making up some fake excuse and it puts the onus upon those who violate the Constitution. If government agents/supervisors/executives bear the responsibility along with the agency, more consideration will may be given before trampling Citizens rights. Moreover, agents should push back against unconstitutional orders from above. If Federal agents are incarcerated for their acts of insurrection against the Constitution and Citizen’s rights, it may empty the Deep State of those who seek to destroy America.
